The present writ petition has been filed seeking a direction to the respondent-MCD to stop illegal and unauthorized construction being carried out by the respondent no.4 in the property bearing Khasra No.379/2, admeasuring 3 Bighas, situated in the Extended Lal Dora Abadi of Village Khera Kalan, Tehsil Alipur, District North Delhi ('subject property'). The petitioner has filed photographs along with the present petition to show the unauthorized construction being carried out.

The petitioner claims to be distantly related to respondent no.4 and submits that the petitioner is a part-owner of the land where the W.P.(C) 5047/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. unauthorized construction is being carried out. 3.

Respondent no.4, who appears in-person, submits that the land where construction is taking place belongs exclusively to respondent no.4. He further submits that unauthorized construction also exists in the adjoining land of which the petition claims to be a co-owner. 4.

Having heard the counsel for the parties, the present writ petition is disposed of while directing the respondent-MCD to do a complete inspection of the entire property falling part of Khasra No.379/2, admeasuring 3 Bighas, situated in the Extended Lal Dora Abadi of Village Khera Kalan, Tehsil Alipur, District North Delhi. 4.1 Based on the inspection, MCD shall take appropriate action in accordance with law.

Liberty is given to the petitioner to take appropriate remedies as per law in the event the petitioner has further grievance. 6.

All rights, contentions and legal remedies of the private respondents are kept open.
