% 19.01.2017 Crl. M.A. No. 1044/2017 (exemption) Allowed, subject to all just exceptions. Application is disposed of. W.P.(CRL) No. 168/2017 Petitioner no. 1 and respondent no. 2 have settled their disputes before Delhi Mediation Centre, Karkardooma Courts, Delhi on 23rd September, 2015. Marriage of petitioner no. 1 and respondent no. 2 has already been dissolved by a decree of divorce by mutual consent on 8th June, 2016 by the

Family Courts, West District, Tis Hazari Courts, Delhi. Respondent no. 2 is being represented through her Attorney.

Even before the Family Court, respondent no. 2 has been represented through Attorney as she settled in New Zealand. Petitioner no. 1 is also settled in New Jersey. Attorney Mr. Anil Nagpal, who is also father of respondent no. 2, is present in Court today and submits that he has got instructions from the respondent no. 2 that she has no objection in case FIR is quashed, in view of the settlement. He submits that entire settled amount has been received by him on behalf of the respondent no. 2.

Keeping in mind the settlement arrived at between the parties and that marriage between the petitioner no. 1 and respondent no. 2 has already been dissolved, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No. 1453/2014 under Sections 498A/406/34 IPC registered at Police Station Madhu Vihar, which is at the investigation stage, is quashed. LOC is also revoked.
