After hearing arguments for some time, learned counsel for petitioner (defendant No.1) does not press the present petition. She, however, submits that, according to defendant No.1, somehow, it was a case of misjoinder of parties and while deciding the abovesaid application, the Court has also imposed a cost of Rs.10,000/- upon them.

She, merely, prays that such cost may be directed to be waived off. 3.

Learned counsel for respondent who appears on advance notice, has no objection to the abovesaid limited request.

Accordingly, the present petition is disposed of as not pressed and, simultaneously, the cost imposed by the learned Trial Court vide order dated 22.01.2025 stands waived.
