Petitioner has sought invocation of contempt jurisdiction of this Court against the respondent and directions to the respondent to pay interim maintenance on the dates according to the order dated 19.02.2025 passed by a co-ordinate bench of this Court. On being pointed out that the interim maintenance order is executable order, learned counsel for petitioner seeks permission to withdraw this petition.

It appears that vide order dated 19.02.2025, the predecessor bench of this Court stayed the execution proceedings qua the DV matter subject to payment of 50% of arrears of interim maintenance within six weeks. The said period of six weeks is expiring on 02.04.2025 but till date the said The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. amount has not been deposited according to learned counsel for petitioner. It is further informed by learned counsel for petitioner that even the monthly interim maintenance directed vide order dated 19.02.2025 is not being paid. 4.

Under these circumstances, the petition is dismissed as withdrawn with liberty to the petitioner to approach the execution court and in case the compliance with order dated 19.02.2025 is not done by the respondent by 02.04.2025, the execution proceedings shall continue.
