% 23.01.2017 Crl.M.A. 1231/2017 Exemption allowed subject to just exceptions. W.P.(CRL) 196/2017 By the present petition the petitioner seeks quashing of FIR No. 292/2016 under Section 376 IPC registered at PS Pahar Ganj on the ground that parties have settled the matter.

Offence punishable under Section 376 IPC being serious in nature, the FIR for the same and the proceedings pursuant thereto cannot be quashed in view of the decision of the Supreme Court reported as 2012 (9) Scale 257: 2012 (10) SCC 303 Gian Singh Vs. State of Punjab & Anr. and (2014) 6 SCC 466 Narinder Singh and Ors.vs. State of Punjab and Anr. Petition is dismissed.
