% 29.03.2019 1.Learned counsel for the Respondents has produced documents before the Court to show that the further medical examination of not only the Petitioner but five other constables in the Railway Protection Special Force („RPSF‟) was undertaken at Mumbai. It revealed that all of them, including the Petitioner, have a congenital eye defect. In the Petitioner‟s case, the reason for his medical de-categorization was „colour blindness‟. Learned counsel for the Respondents further states that a preliminary inquiry has been instituted to examine whether the Petitioner can be re-deployed in view of the altered medical category.

2. In the circumstances, the Court is not inclined to interfere with the movement order dated 26th February, 2019.

3. The petition is accordingly dismissed. The pending application is disposed of.
