It is noticed that petitioner has challenged the order passed while dealing with application under Order XXXIX Rules 1 & 2 r/w Section 151 CPC. Such order is appealable under Order XLIII Rule 1 (r) CPC. 2.
In view of the above, learned counsel for petitioner prays that he may be permitted to withdraw the present petition with liberty to file appropriate appeal.
