This hearing has been done through hybrid mode. 2.

The present petition under Sections 11 & 12 of the Contempt of Courts Act read with Article 215 of the Constitution of India seeks the following prayers:- "(a) Summon, punish and initiate contempt proceedings against the respondents/contemnors for intentionally and deliberately disobeying/non-compliance of the Judgment/order and direction dated 06.12.2023 passed by this Hon'ble Court in Writ Petition [C] No. 244312019 - Sh. Manoj Saklani Vs. Union of India & Ors, in accordance with law;

(b) Pass any other and further order as this Hon'ble Court may deem fit, just and proper in the present facts and circumstances of the case;"

Vide judgment dated 06.12.2023, the learned Division Bench in W.P.(C) 2443/2019 passed the following directions:- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

"31. However, the petitioner shall be awarded one mark for question No.22, and if the same ennures to the benefit of the petitioner making him eligible for promotion, then the same shall be granted to him. Such benefit shall be given only on notional basis as we have been informed that the petitioner has been promoted to the post of Chargeman (Electrical) in the year 2012. Based on the said promotion, the petitioner shall be entitled to seniority from that year. The inter se seniority between the petitioner and the respondent No.5 shall be determined based on the standard criteria followed by the respondents in cases where promotion is effected through Limited Departmental Competitive Examination."

Pursuance thereto, compliance affidavit has been placed on record by the respondent in which it has been stated as under:- "6. In compliance with the direction of the Hon'ble High Court of Delhi vide Judgement dated 06.12.2023, the following actions have been taken by the Respondents:

(a) After pursuing the case file on the administrative side, an Order Part II No. 157 dated 28.02.2024 in respect of the Petitioner for amendment in date of promotion to the post of Chargeman (Tech/Electrical) was issued by Ordnance Factory, Muradnagar. A copy of the said order was handed over to the Petitioner. Copy of the Factory Order Part II No. 157 dated 28.02.2024 issued by Ordnance Factory, Muradnagar and acknowledgment slip dated 29.02.2024 given by the Petitioner along with true typed translated copy are Annexure CA/R-1 (Colly).

(b) Vide office letters dated 28.02.2024. 07.03.2024 and 23.03.2024 issued by Ordnance Factory, Muradnagar, request was made to Directorate of Ordnance (Coordination and Services), Kolkata, for amendment in central seniority list qua the Petitioner.

(c) Vide letter no. 3265/CM(T&NT)/SNTY/MS/GB dated 04.04.2024 issued by Group 'B' Division, Directorate of Ordnance (Coordination and Services), Kolkata, the central seniority list of Chargeman (T/electrical) in respect of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Petitioner, CM/Electrical/OFM, was amended and the same was duly conveyed to the Petitioner vide Acknowledgement receipt dated 06.04.2024. Copy of the letter dated 04.04.2024 issued by Group 'B' Division, DoO(C&S) Kolkata, and Acknowledgment Receipt dated 06.04.2024 given by the Petitioner along with true typed translated copy are Annexure CA/R-2 (Colly). (d) Accordingly, the pay of the Petitioner was also fixed notionally w.e.f. 14.10.2010 to 05.12.2023 as shown in letter No. 258 dated 12.04.2024 issued by Ordnance Factory, Muradnagar. Copy of the said letter was handed over to the Petitioner as well vide Acknowledgement receipt dated 13.04.2024. Copy of the letter dated 12.04.2024 and Acknowledgment Receipt dated 13.04.2024 issued by the Petitioner along with true typed translated copy are Annexure CA/R-3 (Colly).

€ It is humbly submitted that the direction of the Hon'ble Court as issued vide Judgment dated 06.12.2023 has been complied with by the Respondent in toto. Consequential benefits qua fixation of seniority and pay have also been extended to the Petitioner."

Alongwith the said affidavit, the following communication has also been placed on record;

The petitioner, who appears in person, submits that the aforesaid pay fixation is not in accordance with law.

In view of the compliance affidavit placed on record, the writ petition is disposed of with liberty to the petitioner to take appropriate steps, if available in law, before the court of competent jurisdiction.
