The present writ petition has been filed seeking a direction to the respondent no.1/MCD to take action against illegal and unauthorised construction at the property bearing Nos. A-15 & A-16, Shiv Park, Khanpur, New Delhi (hereinafter 'subject property').

Earlier, the RWA of the locality, where the subject property is situated, had filed a writ petition being W.P.(C) 4369/2024, which was disposed of vide order dated 3rd April, 2024, recording the statement on behalf of MCD that the properties have been booked and the demolition order had been W.P.(C) 5134/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. passed.

Subsequently, a contempt petition, being CONT. CAS. 736/2024 was filed, which was disposed of on 31st May, 2024, noting the submission on behalf of MCD that the property has been sealed and the ongoing construction has been stopped.

It is the case of the petitioner that the private respondents have tampered with the seal and resumed construction in the subject property. Photographs have been filed along with the petition to this effect. 5.

Mr. Kapil Dutta, appearing on behalf of the respondent no.1/MCD submits that the fresh demolition order has been passed against the subject property and the fresh demolition action has been planned for 22nd April, 2026.

In view thereof, the present writ petition is disposed of while directing the respondent no.1/MCD to proceed with the demolition action planned on 22nd April, 2026, in accordance with law.

The respondent no.4/SHO, Police Station Neb Sarai, shall provide the necessary police force for carrying out the proposed demolition action. 8.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the owner/occupier/private respondent are kept open.
