O R D E R

% 19.02.2016 This petition has been moved by Shri Surender Kumar Sharma, inter alia, impugning the order of penalty dated 01.02.2013 imposed by the respondent.

It is also, inter alia, alleged that an appeal against the impugned order was moved by the petitioner on 12.03.2013 before the concerned Appellate Authority, which remains to be disposed off despite several requests by the petitioner. He submits that the pendency of the said appeal is also likely to affect his promotional prospects.

Counsel for the respondent, on instructions from Mr. Adib, Manager (Legal) of the respondent, submits that without prejudice to the stand of the respondent and without admitting any facts adverse to the interest of his W.P.(C) 512/2016

clients whilst also reserving the right to file an appropriate traverse to all the allegations that had been made in the petition at a later stage, whenever it becomes necessary to do so, the respondent shall ensure that the appeal is duly considered and disposed off on merits by a speaking order within another eight weeks from today.

Counsel for the petitioner states that he shall be satisfied with this whilst reserving his right to take all further actions in case he remains dissatisfied with the outcome on any grounds that may be available to him in law, including the grounds raised in the instant petition, which have not been adverted to at this stage by him.

It is ordered accordingly.

It is made clear that no opinion is being expressed on the merits of the matter one way or the other.

The writ petition stands disposed off in the aforesaid terms. SUDERSHAN KUMAR MISRA, J.
