1. This is a petition under Section 9 of Arbitration and Conciliation Act, 1996, seeking grant of interim injunction, thereby restraining the respondent from giving effect to its e-mail dated 12.02.2025.

2. As per e-mail dated 12.02.2025, the respondent company gave the time of 45 days to its employees to exercise their ESOP Plans from the date of their letter.

3. It is stated by the learned counsel for the petitioner that the present petition is filed on the ground that the respondent has unilaterally fixed the time which is unreasonable.

handed over a Board Resolution dated 19.03.2025 wherein the period to exercise the option under ESOP Scheme 2009 and ESOP Scheme 2013 has been extended for a period of five years from 19.03.2025. Hence, the immediate concern of the petitioner regarding the deadline of 45 days no longer exists.

Ms. Yadav, learned counsel for the petitioner states that since the immediate deadline of 45 days is no longer in existence, the present petition may be permitted to be withdrawn with liberty to challenge the other issues arising out of the e-mail dated 12.02.2025 as well as the Board Resolution regarding exercise of the petitioner's right in accordance with the Arbitration Clause under the ESOP Plan.

6. Granting the aforesaid liberty and binding the respondent to the Resolution of 19.03.2025, the petition is disposed of.
