O R D E R

The learned counsel for the parties submit that the parties have since arrived at a settlement on 14.02.2024 before the Delhi High Court Mediation and Conciliation. In view thereof, they pray for the present suit be decreed under Order XXIII rule 3 of the Code of the Civil Procedure, 1908. 2.

This Court has perused the contents of the Settlement Agreement dated 14.02.2024 arrived at inter-se the parties and find the same to be lawful.

Accordingly, the present suit is decreed under Order XXIII Rule 3 CPC in terms of Settlement Agreement dated 14.02.2024. 4.

Learned counsel for the plaintiff then prays for the refund of the court fees.

stage of the present suit itself, in the opinion of this Court, refund of 75% of the Court fees paid on the plaint is justifiable. 6.

Accordingly, let a Certificate of refund of 75% of the Court fee paid on the plaint be prepared by the Registry and handed over to the learned counsel for the plaintiff.

Registry is directed to draw up a decree sheet in terms of the aforesaid settlement dated 14.02.2024.

Let a copy of the Settlement Agreement dated 14.02.2024 be appended to form a part of the decree sheet.
