By way of this petition filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter 'the Act') petitioner seeks appointment of an Arbitrator to adjudicate the disputes between the parties arising out of Work Order Agreement dated 18.01.2024/12.02.2024. Arbitration clause is clause 16 of the said agreement. 2.

The disputes having arisen between the parties, petitioner invoked the arbitration clause by giving notice dated 22.01.2026, which was responded to by the respondent. However, no consensus could be arrived at between the parties.

In this backdrop, the petitioner was thus constrained to file present petition under Section 11 of the Act.

The notice was issued in the present petition vide order dated 17.04.2026, pursuant to which Ms. Diksha Belwal had entered appearance on 08.05.2026.

Today, Ms. Belwal submits that the reply has been filed, however, the same is lying under objection. Let her pursue with the Registry and have the reply placed on record within a period of two days. 6.

However, on being queried by the Court as to the existence of arbitration clause, she fairly concedes that the arbitration clause is not in dispute.

Since, the arbitration clause has not been disputed, the present petition is allowed, and the disputes between the parties are referred to arbitration of Mr. Aakash Varma, Advocate; Enrl. No.D/1875/2015 [Mob. 9999331729, E-mail: aakashvarma027@gmail.com].

The arbitration will be held under the aegis of Delhi International Arbitration Centre, Delhi High Court, Sher Shah Road, New Delhi - 110003 ["DIAC"] and shall be governed by the Rules of DIAC including as to the remuneration of the learned Arbitrator.

The DIAC may register the case forthwith.

The learned Arbitrator is requested to furnish a declaration under Section 12 of the Act prior to entering upon the reference. 10.

It is made clear that all rights and contentions of the parties are left open for adjudication by the learned Arbitrator. 11.

Petition stands disposed of.
