The present Petitions under Section 9(1)(ii)(e) read with Section 42A of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Arbitration Act'), have been filed by the Petitioner seeking interim directions to restrain the Respondent from breaching confidentiality of the arbitral proceedings, arbitral records and the Arbitral Award dated 29.08.2022.

Material on record discloses that the Petitioner and the Respondent entered into a Management Services Agreement dated 23.10.2018 for the management and operation of Hotel Green Orchid, Manjhari, Pune & Hotel Blue Orchid, Hinjewadi, Pune.

Disputes arose between the parties, and an Arbitral Tribunal was constituted to adjudicate on the disputes, which passed the Arbitral Award dated 29.08.2022.

It is the case of the Petitioner that Section 42A of the Arbitration Act, which imposes a statutory and mandatory obligation upon the arbitral institutions and the parties to the arbitration agreement to maintain confidentiality of all arbitral proceedings, except in such an award where its disclosure is necessary for the purpose of implementation and enforcement of award, is being violated by the Respondent inasmuch as he is writing letters to various authorities disclosing the contents of the arbitral award. 5.
Attention of this Court has been drawn to the communication dated 21.09.2022, sent by the Delhi International Arbitration Centre (hereinafter referred to as 'DIAC') to the Respondent herein, requesting them not to disseminate information regarding the arbitral proceedings including the arbitral award as the same would be in contravention of Rule 36.1 of the DIAC Rules as well as Section 42A of the Arbitration Act. On instructions, it is stated by the learned Counsel for the Respondent that now, the Respondent will not make any complaint to any of the Authorities/Institutions. This statement of the learned Counsel for the Respondent is taken on record. As such, the Respondent is bound by the statement made by the learned Counsel for the Respondent. 7.
In view of the above, the Petitions are disposed of, along with the pending application(s), if any.
