The present petition is filed under Article 226 of Constitution seeking direction to the respondent no. 2 to dispose of the complaint filed vide diary no. 2978/2023 by the petitioner and to expedite the proceedings as per the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009. 2.

The petitioner is stated to be 78 years old woman who is allegedly continuously harassed by her daughter-in-law and accordingly constrained to file the complaint under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 vide diary no. 2978/2023 on 16.10.2023. 3.

Mr. Rajiv Nayar, the learned Senior Counsel for the petitioner stated that as per the Rule 22(3) of Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009, the limitation to decide the complaint filed by the petitioner vide diary no. 2978/2023 has already been expired on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 31.12.2023. Accordingly, it is stated that the respondents be directed to dispose of the complaint filed vide diary no. 2978/2023 by the petitioner within time bound manner.

Ms. Aditi Saraswat, Advocate who appeared on advance notice on behalf of the respondents stated that every possible endeavour has already been made by the respondent no.2 to dispose of the complaint filed vide diary no. 2978/2023 by the petitioner but due to justified reasons, the complaint could not be disposed of within the stipulated time. The counsel for the respondents also referred the order dated 06.03.2024 passed by another Co-ordinate Bench of this Court in W.P.(C) bearing no. 3392/2024 whereby the direction was given to the concerned authority to dispose of the complaint, preferably within a period of six months from the date of the order.

The petitioner is stated to be 78 years old and filed the complaint on 16.10.2023. Considering the object of the Act as well as the age of the petitioner, the complaint preferred by the petitioner requires expeditious disposal. Accordingly, the respondent no. 2 is directed to make every possible endeavour to dispose of the complaint filed by the petitioner vide diary no. 2978/2023, preferably within a period of three (03) months from the date of receipt of this order.

The present petition along with pending application, stands disposed of.
