The present writ petition has been filed seeking a direction to the respondent no.1/MCD to take necessary steps for the removal of illegal construction, material and debris from the public park located at Plot No. 44 and 45 of Khasra No. 1496, Gali No. 3, Janak Park, Hari Nagar, West Delhi-110064.

Vide order dated 6th January, 2026, this Court had directed the respondent no.1/MCD to file a status report, with respect to the following:- i.

Whether any permission has been taken by RWA/ respondent no.5 from MCD for constructing a badminton court in the park? ii.

Pursuant to the aforesaid order, a status report has been handed over in Court today on behalf of the respondent no.1/MCD. In the status report, it has been stated as under:

i.

On 5th January, 2026, it was observed that certain portion of the park area has been cemented/concretised.

ii.

A complaint dated 5th January, 2026 was filed with the Hari Nagar Police Station and an FIR has been registered on 7th January, 2026. On 31st January, 2026, the respondent no.1/MCD, with the assistance of the local police force, removed the unauthorised concretised/cemented portion of the subject park. iii.

The subject park measures 311.22 sq. mtrs. and out of the total park area, approximately 127.5 sq.

has been covered with cement/concrete. No permission or sanction has been taken from MCD before carrying out the aforesaid construction. 4.

In view of the aforesaid status report, the present writ petition is disposed of while directing the respondent no.1/MCD to forthwith restore the park in its original condition. This exercise shall be carried out in an expeditious manner.

The respondent no.1/MCD shall also ensure that no further construction is carried out in the aforesaid park by any person, including the respondent no.5/RWA.

Pending applications also stand disposed of.
