% 06.04.2016 IA No. 4387/2016 (under Section 151 CPC filed by defendant) By this IA, defendant has prayed for exemption from filing certified copy of the annexure filed alongwith IA No. 4386/2016. The IA is allowed.

IA No. 4386/2016 (under Section 151 CPC filed by defendant) By this IA, defendant has prayed that the record of this suit be also sent to the district court. It is submitted that this suit was consolidated with CS (OS) 551/2012 and this suit was treated as the lead suit for recording evidence as directed by Hon'ble Court vide order dated 07.10.2013. Evidence was to be recorded by learned local commissioner. On 21.07.2015, this suit was dismissed in default. Learned counsel for defendant /applicant submits that Suit No. 551/2012 was transferred to East District, Karkardooma Court on 04.01.2016 and it has been assigned to the court of Ms. Nisha Saxena,

learned ADJ. Learned counsel further submits that the next date of hearing in CS (OS) No. 551/2012 is 18.04.2016. The new suit No (for suit No. 551/2012) is 2267/2016.

Learned counsel for defendant submits that record of this case will also be required for further trial in suit No. 551/2012. The IA is allowed. Registry is directed to send the record of this case to the court of Ms. Nisha Saxena, learned ADJ, District East, Karkardooma Courts for 18.04.2016 through learned District & Sessions Judge, East, Karkardooma courts.
