Learned counsel for the petitioner seeks permission of this Court to withdraw the present petition and states that he will file appropriate application under Section 156 (3) of Cr.PC before the concerned Magistrate for registration of the FIR, since he has the powers to order registration of FIR and supervising the investigation.

This Court has perused prayer No. 2 of the present petition which reads as under:- "Pass an order to suspend the Respondent no. 5 to Respondent no. 8 until the investigation would not be completed, so that the investigation would not be hampering or infringe with their undue influence".

This Court is of the opinion that qua the said prayer, no order is required to be passed by this Court. However, this writ petition be treated as a representation by the concerned DCP to take further necessary action in relation to prayer No. 2 of the present writ petition. However, it is clarified that the DCP concerned will pass orders without being influenced by this order and may take appropriate action, if required, as per the prevailing laws and the same shall be intimated to the petitioner herein. This Court further clarifies that no opinion has been expressed on the merits of the case. 4.

In view thereof, the petition is disposed of in the above terms along with pending application, if any.
