Learned counsel appearing for the petitioner seeks liberty to withdraw the instant petition in view of the judgment passed by this Court in CS(OS) 973/1994 dated 11.01.2018 titled as S. Satinder Singh & Ors. \v. S. Raminder Sarup Singh & Anr.

The request for withdrawal is opposed by learned counsel appearing for the respondent.

Needless to state, if the respondent has any claim against the petitioners, they shall be at liberty to take out appropriate proceedings in accordance with law.

However, if learned counsel appearing for the petitioners seeks liberty to withdraw the instant petition, the request cannot be refused on the ground that the respondent had certain grievances against the petitioners unless the withdrawal is with malafide intent.
