% 27.03.2024 CM APPL. 18509/2024 (Seeking direction in view of the settlement agreement) Learned counsel appearing on behalf of the parties jointly submitted that the dispute between the parties stands settled with the intervention of the Delhi High Court Mediation and Conciliation Centre vide settlement agreement dated 19.02.2024 and the same is on record. Hence, in view of the settlement having been arrived at between the parties, it is prayed that the matter may be disposed of in terms of the settlement and the impugned judgment dated 31.01.2023 may be suitably modified. The appellant as well as the respondent are present today. On the query made by this Court, the appellant and the respondent have categorically stated that they have entered into the settlement on their own free will and without any coercion. It is also stated by the parties that the entire dispute has been amicably settled between them and the part terms of the settlement have also been acted upon.

This Court has perused the settlement agreement dated 19.02.2024 and found nothing unlawful therein.

During the course of the proceedings, the appellant has handed over a Demand Draft bearing No. 198336, amounting to Rs.1,50,000/- dated 09.02.2024 in favour of the respondent Mr.Moin Ahmad, drawn on Kotak Mahindra Bank, New Delhi.

Let the remaining terms of the settlement agreement be also acted upon by all the parties and the said terms be also adhered to by the Registry. In view of the above, this Court modifies the impugned judgment dated 31.01.2023 in terms of the settlement agreement dated 19.02.2024. Order accordingly.

The application stands disposed of.
