% 03.09.2025 CM APPL. 17576/2025 By way of the present application filed under section 151 of the Code of Civil Procedure 1908, the appellant seeks condonation of about 21 days' delay in re-filing the present second appeal. 2.

For the reasons stated in the application, which is duly supported by affidavit, the delay is condoned.

The application is allowed and disposed-of.

Further to what was recorded in order dated 26.08.2025, Mr. Rambhakt Agarwal, learned counsel who was appointed by the court to assist the respondent, submits, that he has explained to the respondent the contents and consequences of Compromise Deed dated 15.04.2025, that has been executed between the appellant and the respondent.

Mr. Agarwal submits, that the respondent has confirmed to him that she has affixed her thumb impression on the compromise deed voluntarily and of her own free volition, after she was explained the contents thereof in the vernacular.

In these circumstances, Mr. Aldanish Rein, learned counsel for the appellant submits, that that the present second appeal be disposed-of in the terms contained in Compromise Deed dated 15.04.2025 signed between the parties.

The appellant and the respondent are present in court. Upon the court enquiring from them, they have affirmed the contents of the compromise deed executed by them.

Furthermore, the respondent has confirmed that she will not initiate any action in execution against the appellant in relation to the property, being the Ground Floor of property bearing No.17, 18, and 19, Andh Vidhyalaya, Dargah Syed Hussain, Panchkuian Road, New Delhi.

In view of the above, the present second appeal is disposed-of, taking on record the terms of Compromise Deed dated 15.04.2025; and holding the parties bound by the terms thereof. 10.

Pending applications, if any, also stand disposed-of.
