W.P.(CRL.) 174/2017 This is a petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. for quashing of FIR No.0383/2016, under Section 354-A IPC, registered at Police Station Sagarpur, Delhi and all consequential proceedings arising therefrom.

Learned counsel for the petitioner has submitted that due to some misunderstanding between the parties, the respondent No.2/complainant Seema @ Shivani got registered an FIR No.0383/2016, under Section 354-A IPC at Police Station Sagarpur, New Delhi. Counsel further submits that after the registration of the FIR, the near relatives and friends intervened and the matter has been amicably settled between the parties and the affidavit of

the respondent No.2 to this effect has also been filed/placed on record. Counsel further submits that since the matter has been amicably settled between the parties and nothing further remains to be adjudicated further, however, the present FIR is coming as a hurdle in the peaceful life of both the parties and prays that the aforesaid FIR may be quashed. The respondent No.2/complainant is present in Court and has been identified by the Investigating Officer, Sub Inspector Pradeep Kumar. The complainant is present in person and admits the factum of amicable settlement with the petitioner to be voluntary and without any force, pressure or coercion. The complainant further submits that she has filed an affidavit dated 21.10.2016 to this effect and further submits that nothing further remains to be adjudicated between them and that she has no objection if the aforesaid FIR is quashed.

Looking into the above facts and circumstances, since the matter has been amicably settled/compromised between the parties and nothing further remains to be adjudicated between the parties, I deem it appropriate to quash the FIR in question.

Consequently, FIR No.0383/2016, under Section 354-A IPC, registered at Police Station Sagarpur, Delhi and all consequential proceedings arising therefrom are hereby quashed. The present petition is allowed and stands disposed of accordingly. Copy of this order be given dasti to the parties, as prayed. I.S.MEHTA, J JANUARY 20, 2017 'dc'
