% 06.09.2024 Learned senior counsel for the respondents submits that, regarding the present dispute, Civil Suit No. CS/SCJ/849/2022 titled Gurlad Singh vs. Ram Niwas HUF has already been filed by the respondents and is pending consideration. The learned senior counsel further submits that the impugned order dated 14.02.2022 has effectively lapsed, as it has not been confirmed as required under Sections 137 and 138 of the Criminal Procedure Code, 1973.

petition has become infructuous and may be disposed of, leaving all the contentions open to be determined during the course of the civil suit. Per contra, learned counsel for the petitioner submits that he has challenged the jurisdiction of the learned SDM in passing the order. Considering that the parties are already before the Civil Court for adjudication of their rights, and keeping the contention regarding the jurisdiction of the learned SDM open, the present petition stands disposed of, leaving all the contentions of the parties to be decided by the learned Trial Court.
It is clarified that this Court has not examined the merits of the case, and the same shall be decided by the learned Trial Court. In view of the above, the present petition, along with its applications, stands disposed of.
