The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.51/2013 registered under Sections 328/354/342/376(g)/34 IPC at PS Khajuri Khas. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 13.02.2013. Coaccused persons have already been granted bail. The prosecutrix and her father have been examined.

At the time of recording her examination-in-chief on 17.09.2013, the prosecutrix did not identify the petitioner to be one of the assailants.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the Trial Court.
