O R D E R

The petitioner in the present petition seeks a limited prayer viz. that it be allowed to make payment of the "settlement amount", as referred to in the communication dated 17.07.2025 issued by the Deutsche Bank to the petitioner / borrower, for removal of charge / lien of the said bank in respect of the property No. CP-232, CP Block, Pitampura New Delhi (hereinafter referred to as 'subject property').

It is submitted by the learned counsel for the petitioner that for the purpose of payment of the said amount, no further lien shall be created in respect of the subject property, nor will the attachment thereof by the Directorate of Enforcement (ED), be impacted in any matter. Further, it is agreed that upon payment of the said amount to the Deutsche Bank, the original title document/s in respect of the subject property shall be released directly by the bank to the concerned official/s of the Directorate of Enforcement (ED).

It is further agreed by respective counsel that the same shall be : (i) without prejudice to the outcome of the pending legal proceedings, including the pending appeals initiated by the petitioner before the appellate tribunal under the Prevention of Money Laundering Act, 2002 as well as any other proceeding/s; (ii) without prejudice to the rights and contentions of the respondent no. 1 / Directorate of Enforcement (ED) in the present case, as also in other pending legal proceedings.

In the circumstances, the petitioner is at liberty to arrange/make payment of requisite amount/s (as aforesaid) to Deutsche Bank, in accordance with the understanding set out hereinabove. 5.
