1. None has appeared for the Respondents despite service through courier and e-mail. The Respondents are according proceeded ex parte.

2. The assertion by the Petitioner of the existence of the arbitration clause and its invocation by notice dated 22nd June, 2016 are not controverted.

3. The Court accordingly appoints Ms. Sunita Harish, Advocate (Mobile No.9811328320) as the sole Arbitrator to adjudicate the disputes between the parties including claims and counter-claims. The arbitration shall take ARB.P. 81/2017

place under the aegis of the Delhi International Arbitration Centre („DAC‟). The fees of the learned Arbitrator will be in terms of the Delhi High Court Arbitration Centre (Arbitrators‟ Fees) Rules. The Arbitrator will proceed in accordance with the Arbitration and Conciliation Act 1996 as amended with effect from 23rd October 2015.

4. The parties to appear before the Additional Coordinator, DAC at 11:00 a.m. on 25th April, 2017 for further steps.

5. The petition is disposed of in the above terms. A copy of this order be communicated to the learned Arbitrator as well as Additional Coordinator, DAC forthwith.
