The present writ petition has been filed seeking a direction to the respondent no. 6/ SHO, P.S. Prashant Vihar to provide adequate police protection and assistance to the petitioners to install a lift along with a connecting bridge at the property being Adarsh Bhawan Apartments, Plot No. 37, Sector-9, Rohini, Delhi-110085.

the same locality, are creating hinderances in the construction and installation of the lift. The respondent no.1/ MCD had granted permission to install the lift along with the connecting bridge. 3.

The private respondents no.2 to 5 had filed an appeal before the Appellate Tribunal, MCD (ATMCD), which was dismissed vide order dated 10th November, 2025. Against the said order, the private respondents no.2 to 5 have filed an appeal before the learned Principal District & Sessions Judge, North District, Rohini Courts, Delhi (District Judge) which is stated to be pending. However, no stay of the aforesaid order has been granted by the District Judge.

In these circumstances, there cannot be any hinderance caused to the petitioners in the installation of the lift along with the connecting bridge. 5.

Attention of the Court has been drawn to order dated 13th November, 2025, passed by the Co-ordinate Bench of this court in W.P.(C) 17257/2025, titled Sandeep Kumar Vats & Ors. v. Municipal Corporation of Delhi & Ors. In similar circumstances, this Court had ordered the concerned SHO to provide assistance for the installation of the lift. 6.

In view thereof, the present writ petition is disposed of, directing that in case the petitioners face any impediment in carrying out the work for installation of the lift, the petitioners have the liberty to seek the assistance of the respondent no.6/ SHO, P.S. Prashant Vihar. 7.

In case, the petitioners seek assistance of the respondent no.6/ SHO, P.S. Prashant Vihar, the SHO shall ensure appropriate assistance is provided to the petitioners, so that they can carry out their work without any hinderance, in terms of the permission granted by the respondent no.1/ MCD.

The private respondents no.2 to 5, who are represented through counsel, are also directed not to cause any hinderance in the installation of the lift.
