These petitions are being disposed of by this order as the facts and the issue involved is common. For convenience, the facts are being taken from W.P. (C) 5658/2022. The writ petition was filed aggrieved of notice dated 24.03.2022 issued by the Deputy Conservator of Forest, West Forest Division, New Delhi, wherein it has been stated that the land in Khasra No. 1038, 1020, 1012/2, 1495/1, 1494, 1797 and sapera camp, Gulabo Camp, Nala Camp, Israil Camp, Shankar Camp and others Rangpuri Reserve Forest of village Rangpuri Tehsil Vasant Vihar, has been encroached and the encroachers should vacate the land within fourteen days, failing which the structures shall be demolished. This petition relates to Khasra No. 1012/2. 2.

The contention of the learned counsel for the petitioner is that the petitioners are the owner in possession of the land and are not the encroachers and the respondent erred in issuing impugned notice. 3.

The writ petition was filed against the notice without filing a response thereto. The petitioners were protected by this court by passing an interim order.

Without commenting upon the merits of the case, the writ petition is disposed of with the directions that the petitioners shall file response to the impugned notice within three weeks from today. The competent officer of the forest department shall take the decision in accordance with law on the notice issued after providing opportunity of hearing to the petitioner. The interim protection granted by this court shall continue till the decision is taken and two weeks thereafter.
