O R D E R

This petition has been filed, challenging the Order dated 28.09.2018 passed by learned Central Administrative Tribunal, Principal Bench (hereinafter referred to as, the 'Tribunal') in O.A. No. 2879/2018, titled Amarjeet Singh v. Govt. of NCT of Delhi and Ors., whereby the said O.A. filed by the respondent herein was allowed with the following directions:

"7. In the conspectus of the discussions in the foregoing paras, we allow this OA and direct the respondents to include the components of HRA, TA, Ration Money and Metro allowance in computing his salary during the period of suspension and pay him subsistence allowance in accordance with FR-53 and Annexure A-2 order dated 30.11.2014. We further direct the respondents to refund the amount already recovered from the subsistence allowance of the applicant. This shall be done within a period of two months from the date of receipt of a copy of this order."

The aforesaid O.A. had been filed by the respondent herein, praying for the following reliefs:

"1. To quash and set aside the impugned Reduction of Basic Pay, Non-Payment of HRA and Ration Money and Recovery of Rs.6000/- per month with all consequential benefits.

2. To direct the respondents to restore to the applicant subsistence allowance of 75% of Basic Pay w.e.f. Jan, 2018 and make payment of 75% of Basic Pay w.e.f. Jan, 2018 with all consequential benefits.

3. To direct the respondents to pay to the applicant HRA and Ration money w.e.f. Mar, 2018 with all consequential benefits.

4. To direct the respondents to pay back the recovery of Rs.6000/- per month made from the pay and allowances of the applicant w.e.f. Mar, 2018 with all consequential benefits.

5.To award costs in favor of the applicant and pass any order or orders, which this Hon'ble Tribunal may deem just & equitable in the facts & circumstances of the case.

Strangely, the learned Tribunal in its Impugned Order did not discuss the reliefs which have been claimed by the respondent or the basis of making such claims, but instead, the learned Tribunal simply observed that the Subsistence Allowance is to include the House Rent Allowance, Ration Money, Transport Allowance etc. 4.

We are of the considered view that the said Order of the learned Tribunal is non-speaking in nature and, therefore, not sustainable in law. Accordingly, the same is set aside.

adjudicated upon by the learned Tribunal, we restore the aforesaid O.A., back to its original number before the learned Tribunal. The parties shall appear before the learned Tribunal on 19th December, 2025.

The learned Tribunal shall consider the O.A. afresh, strictly in accordance with law, and keeping in view the submissions made by the respondent in the O.A. and the reliefs claimed therein. 7.

In view of the fact that the O.A. was filed by the respondent as far back as in the year 2018, we request the learned Tribunal to dispose of the same expeditiously and, preferably, within a period of six months from its first listing.

Needless to state, we have not expressed any opinion on the merits of the respondent's claim.
