This petition has been preferred on behalf of the Petitioner seeking appointment of an Arbitral Tribunal or a sole Arbitrator in terms of Clause 16 of the arbitration clause in the distribution agreement dated 09.09.2020. Admittedly, no invocation notice has been sent by the Petitioner to the Respondents under Section 21 of the Arbitration and Conciliation Act, 1996. 4.
Accordingly, this petition cannot be entertained at this stage and accordingly, is dismissed with liberty to the Petitioner to take recourse to appropriate steps for invoking the arbitration agreement between the parties. 5.
