The present bail application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail in FIR No. 240/2017 dated 02.07.2017, registered at Police Station Mayur Vihar-I, for offence under Section 364 of the Indian Penal Code, 1860 ('IPC'). The chargesheet has been filed against the applicant for the offences under Sections 364/302/120B/34 of the IPC.

It is pointed out that the bail application filed by the coaccused Sandeep Kumar Sharma was disposed of by this Court by order dated 29.04.2024, after noting that only a few formal witnesses remained to be examined and the trial is at the fag end. In such circumstances, this Court did not consider it apposite to entertain the bail application. Considering that the co-accused was in custody since the year 2017, the learned Trial Court was requested to conclude the trial within a period of five to six months.

It is again submitted that a few witnesses still remain to be examined.

Considering the advanced stage of the trial, the present bail application is disposed of with a direction to the learned Trial Court to make endeavour to conclude the trial within a period of five to six months.

The applicant is at liberty to file a fresh bail application if the trial is not concluded within a period of five to six months.
