The present petition has been filed seeking direction to the respondent-MCD to stop the unauthorised construction being carried out at the property bearing no. M-28/A-1, Pocket-M, Dilshad Garden, Delhi110095 (hereinafter 'subject property'). Counsel appearing on behalf of the respondent-MCD, on advance notice, submits that the subject property has been inspected and encroachment has been found therein. Counsel submits that appropriate action shall be taken within ten (10) days from today. 3.

Taking on record the aforesaid statement, the petition is disposed of. 4.

SHO, P.S. Seema Puri who is respondent no.3, is directed to provide adequate police protection to the respondent-MCD to take the requisite action.

The pending applications also stand disposed of. 6.

In the event, the petitioners have any further grievance with regard to the encroachment/ unauthorised construction, they are at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the private respondent no.5 are kept open.
