By way of the present petition, the petitioner seeks restoration of CC NI Act 20601/2023 titled as "Bhagwat Dayal v. Deepak Kumar Karn", to its original stage.

The learned counsel for the petitioner impugns order dated 28.11.2024, passed by the learned Judicial Magistrate-1st Class (NI Act)- 09/South-West, Dwarka vide which the complaint filed by him was dismissed for non-prosecution. It is stated that the respondent was not yet summoned by the learned Trial Court on the day when the complaint came to be dismissed by the learned Trial Court.
