% 19.03.2020 Issue notice. Mr. Mehra accepts notice on behalf of the State. The petitioner has preferred the present petition to seek a writ of Habeas Corpus for production of his wife - Shilpa, whom he married as per Hindu rites and ceremonies on 03.01.2020. According to the petitioner, Shilpa went to her parental home after the marriage, thereafter he has been in touch with her. The petitioner has placed on record several messages exchanged by him with Shilpa in support of his submission that Shilpa was being tortured and pressurised by her parents on account of her marriage
with the petitioner. The petitioner made a police complaint on 11.03.2020, where after he has preferred this petition.
Shilpa has been produced in Court. We have interacted with her in Chamber. Though, Shilpa does not deny the fact that she has married the petitioner, she states that she does wish to live with the petitioner. During our interaction with Shilpa and Ajit in Chamber, Shilpa stated that Ajit has access to her Facebook Account over his mobile phone, this was denied by the petitioner Ajit. She was provided the mobile phone of Ajit, however, she could not access her Facebook account through Ajit's mobile phone. She, thereafter proceeded to delete some photographs from Ajit's phone photo gallery. At this stage, the mobile phone was returned to Ajit.
Since, Shilpa has been produced and she does not wish to reside with the petitioner, no further orders are called for in this petition. We direct Ajit not to contact Shilpa of his own accord. He shall not misuse any photographs of himself and Shilpa by circulating the same on any social platform.
