Petitioners seek quashing of FIR No. 140/2017 of PS Patel Nagar for offence under Section 498A/406/34 IPC on the ground that they have compromised all disputes. State has no objection in view of the nature of offence. Respondent no. 2 also has no objection to this petition. 2.

Parties are present in court, identified by IO/SI Dharmender Sharma present in court as well as counsel for parties. 3.

I have spoken with the parties and it is stated by them that they have compromised all disputes including maintenance and custody of daughter of the parties. petitioner no. 1 and respondent no. 2 already stand dissolved by decree of divorce by mutual consent. Parties have reduced their settlement into writing, a settlement agreement dated 22.07.2024, copy whereof has been placed on record. Custody of daughter of petitioner no. 1 and respondent no. 2 is and shall remain with respondent no. 2.

Having spoken with the parties, I am satisfied that pushing the parties through trial would not be in the interest of justice. I am satisfied that in order to get permanent quietus of the disputes, it would be necessary that the present petition is allowed.

Therefore, the petition is allowed and consequently FIR No. 140/2017 of PS Patel Nagar for offence under Section 498A/406/34 IPC and the proceedings arising therefrom are quashed.
