Applicant seeks regular bail in case FIR No.211/2025 dated 04.05.2025, registered at P.S. Ambedkar Nagar, for commission of offences under Sections 65(1)/351 of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 376(3)/503 IPC) and Section 6 of Protection of Children from Sexual Offences (POCSO) Act, 2012. 2.

Applicant is in custody since 19.05.2025 and was 22 years of age when he was arrested.

According to the stand taken by the applicant, he and prosecutrix knew each other and wanted to marry each other. When family members of applicant wanted him to marry somewhere else, feeling apprehended and cheated, a complaint was made against him.

relationship which has been given colour of criminality. 5.

It is also not denied that prosecutrix and her mother, the most material witnesses in the case in hand, have already entered into witness-box and though their deposition is in synchronization with what they had stated during the investigation, fact remains that as on date, there is no chance of applicant influencing them in any manner whatsoever as their deposition has already been recorded 6.

Since, respondent No. 2 is party to the present bail application, investigating officer was asked to get in touch with her so that her response, if any, can be considered and regarded. She is present in Court with her parents and during course of arguments, she and her parents stated that they would have no objection if the applicant is released on bail. 7.

Keeping in mind the young age of the applicant, the fact that prosecutrix has already entered into witness box and the fact that there is no likelihood of trial getting completed in near future, albeit, without expressing anything on merits of the case, applicant is hereby admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- with one local surety subject to the satisfaction of learned Trial Court/CMM/Duty Judicial Magistrate First Class.
