The present writ petition has been filed seeking a direction to the respondent no.1/MCD to take action against the unauthorised construction being carried out by the private respondent no.3 at property bearing No.145, Pillinji, Taimoor Nagar, New Delhi.

It is stated that the petitioner is a resident of a house adjacent to the back side of the house of the private respondent no.3. It is further stated that the illegal construction carried out by respondent no.3 has affected the air and light in the petitioner's house. Photographs have been filed along with the petition showing the unauthorised construction. 3.

Counsel appears on behalf of the respondent no.1/MCD on advance notice and submits that a Show Cause Notice dated 17th April, 2026 has W.P.(C) 5215/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. been issued to the respondent no.3 taking note of the unauthorised construction being carried out.

3.1 Copy of the said notice has been handed over in Court and the same is taken on record.

Accordingly, the present writ petition is disposed of while directing respondent no.1/MCD to take action in an expeditious manner in respect of the unauthorised construction.

Pending application stands disposed of.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

7.

All rights, contentions and remedies of the owner/occupier/private respondent are kept open.
