O R D E R

This is a petition filed under section 34 of the Arbitration and Conciliation Act, 1996 seeking to challenge the Arbitral Award dated 20.12.2024.

In the said award, the claims of the respondent were allowed as under:-

1. The Claimant is held entitled to recover from the Respondent an amount of Rs 2,48,93,641/- (Rupees Two Crores Forty-Eight Lakhs Ninety-Three Thousand Six Hundred and Forty-One Only), being the money due and outstanding for the supplies made under the subject contract.

2. The Claimant is also held entitled to recover from the Respondent interest @ 12.30 % per annum with effect from 01.04.2022 to the date of this Award and, also future interest @ 17.15% per annum with effect from the date of this Award, over and above the said principal sum of Rs. 2,48,93,641/- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. (Rupees Two Crores Forty-Eight Lakhs Ninety-Three Thousand Six Hundred and Forty-One Only), till payment/recovery.

3. The Respondent is further held liable and so directed to return to the Claimant PBG No. 20/2017 dated 10.07.2017 for Rs. 6,06,313/- and PBG No. 2560BG-024-19 dated 18.02.2019 for Rs, 77,88,000/-.

The Claimant is also held entitled to recover from the Respondent costs of these proceedings, quantified in the sum of Rs. 16,02,793/- (Rupees Sixteen Lakhs Two Thousand Seven Hundred and Ninety-Three only) with interest @ 15.15% per annum with effect from the date of this Award till payment/recovery.

During the pendency of the present proceedings, the parties have arrived at a settlement. As per the terms of the settlement, the petitioner shall pay the entire awarded amount to the respondent within 3 weeks from today. 4.

The interest awarded in paragraph 2 and 5 is agreed to be 12%. 5.

The payment which will be made will be inclusive of this interest at the rate of 12%.

Binding the petitioner to the above compromise, the petition is disposed of.
