By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks setting aside of the summoning order dated 20.09.2021 passed by learned Judicial Magistrate (NI Act) Digital Court-01(West) Tis Hazari Court, Delhi in Complaint Case No.2064/2021 under Section 138 of the Negotiable Instruments Act, 1881.

After some hearing, Mr. Rohit Kishore learned counsel for the petitioner, seeks permission to withdraw this petition, without prejudice to the rights and remedies of the petitioner before the learned Trial Court. 3.

The petition, alongwith the pending applications, is dismissed as withdrawn.

It is clarified that this Court has not made any observation on the merits of the case, and all rights and contentions of the parties are left open.
