This petition has been preferred by the Petitioner under Section 29A of the Arbitration and Conciliation Act, 1996 ('1996 Act') for extension of time for the Arbitral Tribunal to pass the Arbitral Award. 4.

The present Tribunal came into existence vide order dated 23.05.2022 passed by this Court in Arb. P. No. 523/2022. It is averred that in terms the notice issued by the Tribunal vide order dated 19.07.2022, both parties appeared and filed their respective pleadings. Rejoinder was filed by the Claimant on 14.06.2023.

It is further submitted that in terms of Section 29A of the 1996 Act, the stipulated period of one year expired on 13.06.2024, following which, with the consent of both the parties, the mandate of the Tribunal was extended for a period of 6 months, which expired on 12.12.2024. Claimant has filed this petition for a further extension to enable the Ld. Arbitrator to pass the final award.

Mr. Tushar Sannu, learned counsel accepts notice on behalf of the Respondents.

It is stated by learned counsels for the parties that the proceedings before the Arbitral Tribunal are at the stage of passing of the award. Therefore, learned counsel for the Petitioner submits that in the interest of justice, mandate of the Arbitral Tribunal be extended by a period of two months. Learned counsel for Respondents has no objection to the extension of the mandate.

Accordingly, this petition is allowed extending the mandate of the Arbitral Tribunal by two months from today, to enable the Tribunal to pass the award.

Accordingly, for the reasons stated in the petition and with the consent of the parties, mandate of the Arbitral Tribunal is extended by a period of two months from 27.03.2025, enabling the Arbitral Tribunal to pass the award.
