This petition is filed seeking anticipatory bail in FIR No.191/2023 under Section 420/IPC P S: Janakpuri on the allegation that petitioner had decamped with complainant's Black Mercedes Benz Car. 2.

On 9th April 2024, interim protection was granted to petitioner subject to his complying with the undertaking that he shall hand over the car to the IO. On 30th April 2024, counsel for the petitioner expressed his inability to hand over the car saying that the car was sold out to a scrap dealer for an amount of Rs.2 Lakhs and the said scrap dealer is not returning the vehicle. Interim protection granted to petitioner was vacated and matter was renotified for 10th July 2024. 3.

stated that they are now willing to hand over the car to the IO within a period of two days.

Accordingly, it is reported by the IO, that in the intervening night of 14th and 15th July 2024 petitioner did return the car to the Duty Officer but did not chose to meet the IO or any other responsible officer at the police station at that stage.

Considering the conflicting stands taken by petitioner at various stages and that he has not joined investigation till date, as also his conduct of not complying with their own offer to the Court on two occasions - first on 9th April 2024 when it was stated that they shall deposit the car but later sated that it was sold off for scrap, and thereafter on 10th July 2024, when they stated that they shall deposit the car within 2 days whereas it was deposited after 5 days, this Court is not inclined to grant any further relief to petitioner. 6.

Petition is accordingly dismissed along with pending applications, if any.
