The learned counsel for the applicant submits that the applicant has been in custody for almost 6 years, but the trial is not proceeding and only 2 witnesses have been examined so far. He submits that the applicant shall be satisfied if a direction is issued to the learned Trial Court to expedite the trial.

Keeping in view the submission made, the learned Trial Court is directed to expedite the trial and make endeavors to conclude the same within a period of 1 year from the first listing of the same post this Order. In case there is further delay in conclusion of the trial not attributable to the applicant, the applicant shall be at liberty to revive his application for seeking bail.

In view of the above, the learned counsel for the applicant prays for leave to withdraw the present application.
