O R D E R

% 03.07.2024 1.

The present application is filed under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 346/2019 dated 09.09.2019, registered at Police Station Kanjhawala, for offences under Sections 498A/304B/201/34 of the Indian Penal Code, 1860.

The bail application filed by the applicant on an earlier occasion was dismissed as withdrawn by this Court by order dated 30.10.2023. The learned counsel for the applicant submits that after the dismissal of bail application, the trial is not proceeding for want of the FSL Report.

The learned Additional Public Prosecutor for the State submits that only few witnesses are not examined due to pendency of the FSL Report, however, the trial is proceeding with examination of the remaining witnesses and this is not a case where the matter is getting unneccesssarily adjourned before The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. He further submits that all possible efforts are being made to procure the FSL Report and he is hopeful that the trial would conclude expeditiously.

In view of the above, this Court does not consider it apposite to entertain the present application at this stage. 6.

However, it is pertinent to note that the applicant is in custody since 10.09.2019.

The learned Trial Court is requested to expedite the trial. 8.

The applicant is at liberty to file an application afresh in case the trial does not conclude within a period of six months from date.

The present application is dismissed with the aforesaid liberty.
