The present petition under Section 115 of the CPC, read with Section 25B (8) of DRC Act, seeks the following prayers: - "a) Set aside the impugned order and judgement dated 29.10.2021 passed by the Ld. ARC Delhi passing the leave to defend on the ground of bonafide requirement of the respondent. b) Dismiss the present leave to defend with cost c) Any other order/direction that this Hon'ble Court may deem fit and proper in the circumstances of the present case maybe passed in favour of the petitioner and against the respondent." Learned counsel appearing on behalf of the petitioner, without prejudice to the rights and contentions, seeks leave of this Court to withdraw the present petition, with a prayer for an expeditious disposal of the trial pending before the learned ARC.

The present petition is dismissed as withdrawn and disposed of. 7.

In view thereof, learned ARC is requested to expedite the hearing of the trial pending before it, and make an endeavour to conclude the same, preferably within a period of 6 months, without giving undue adjournments to either of the parties.
