The present petition has been filed under Article 227 of the Constitution of India impugning the order dated 26.02.2024 passed by the ADJ-03, Shahdara, Karkardooma Courts, Delhi (hereinafter referred as „Trial Court‟) in CS 112/24 titled "CHANDRA CREATIVE & CONTENTS SOLUTION PVT. LTD. VS. ANKIT TYAGI".

Learned counsel for the respondent has put in appearance on advance notice.

a suit for permanent injunction and damages against the respondent which came to be instituted before the learned ADJ and heard on 26.02.2024. The learned Trial Court vide impugned order though issued summons of the suit but did not issue notice with respect to the application moved under Order XXXIX Rule 1 and 2 CPC and also has not granted ad-interim injunction though it was prayed.

At this stage, learned counsel submits that he wishes to withdraw the present petition subject to liberty being granted for moving an appropriate application as per law before the learned Trial Court for hearing the application Order XXXIX Rule 1 and 2 CPC.

Permission and liberty, as prayed for in accordance with law, is granted.
