% 24.01.2018 Petitioner is seeking parole for the reasons mentioned in the petition. One such reason is to file an SLP against the dismissal of his appeal by this court on 05.06.2017. Petitioner is a convict under Section 10 of the POCSO Act. His is sentenced to undergo RI for a period of 6 years and a fine of Rs 10,000/- and in default of payment of fine to undergo SI for a period of 6 months. As on 11.01.2018, his nominal roll reflects that he has undergone incarceration of about 5 years and plus which includes his remission. His jail conduct has been satisfactory. Status report has been filed by the State. The family members of the petitioner are stated to be residing at the Jhuggi (address mentioned in the petition) at Shankar Camp,
Rangpuri Phari, Vasant Kunj, New Delhi. Since the victim in the instant case was the minor daughter of the petitioner, the petitioner if granted aforenoted relief prayed for by him will not visit the jhuggi where his daughter is residing with her parents or in that vicinity. Petitioner is granted parole for a period of 4 weeks to be counted from the date of his release on furnishing of a personal bond in the sum of Rs. 10,000/- with one surety of the like amount to the satisfaction of the concerned trail court. Apart from the condition noted supra, he shall also furnish his latest residential address and mobile number to the concerned SHO; he shall also report on every Monday of each week to the concerned SHO.
Petition disposed of in the above terms.
A copy of this order be sent to the Jail Superintendant concerned for intimation to the petitioner.
