This is a petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for a Writ in the nature of Habeas Corpus directing the respondents to find and produce the husband of the petitioner, namely, Mr. Dipak Kumar Samantha.

In the petition, it is alleged that some unknown persons had forcibly entered the petitioner's house and taken away Mr. Dipak Kumar Samantha on 13.04.2026. that the petitioner is in custody of City Police Station, Palwal, however, no further information regarding his whereabouts was given to the petitioner. The present petition has been filed as the petitioner is apprehensive about the safety and security of her husband. 3.
On advance notice of this petition, the learned Standing Counsel for the respondent no. 2 has handed over a copy of the Status Report dated 19.04.2026, which is taken on record. It, inter-alia, states that Mr. Samantha has been arrested in FIR No. 155/2026 under Section 126/140(3)/310(2)/319 BNS, PS City Palwal, District-Palwal, Haryana. The arrest was carried out in accordance with law and only because Mr. Samantha did not appear for investigation in spite of a notice issued to him. The petitioner was also informed of the arrest. Mr. Samantha was thereafter produced before the competent court on 17.04.2026, and by an order of the same date, was remanded to police custody for three days. He is to be produced before the competent court today.

The learned counsel for the State of Haryana is also present and makes similar submissions.

Keeping in view that presently Mr. Samantha is in police remand pursuant to an order dated 17.04.2026 passed by the learned ACJM Palwal, no further orders are required to be passed in the present petition. In case there is any grievance of the petitioner/Mr. Samantha on his arrest, the same can be raised and can be adjudicated by the competent court.

The petition is accordingly disposed of, leaving it open to the petitioner/Mr. Samantha to avail of their remedies in accordance with The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
