% 23.01.2017 Petitioner is aggrieved by the illegal and unauthorized construction which is being permitted in property bearing No.149, Hauz Khas, Malviya Nagar, New Delhi. It is stated that this is without a sanction plan.

On advance notice, learned counsel for SDMC has put in appearance. Her submission is that this property was booked; demolition order was passed on 22.11.2016; partial demolition took place on 07.12.2016; further demolition programme was fixed for 10.01.2017 but no demolition could be effected in the absence of police assistance; now the demolition programme is fixed for February, 2017. This statement of the respondent no.1/SDMC is

taken on record. The commitment made before this Court will be honoured in true letter and spirit and the demolition programme shall be taken to its ultimate goal. Police assistance (from respondent no.2) shall also be obtained by respondent no.1 as and when it is required for the demolition action now fixed for February, 2017. Needless to state that respondent no.3 shall be intimated prior any adverse action is taken against his property. At this stage, learned counsel for the petitioner submits that as far as his instructions go, the unauthorized construction is still going on. This statement of the petitioner is noted and conveyed to respondent no.1 who shall deal with the same in accordance with law with the assistance of respondent no.2.

No further orders are called for in this petition. Petition disposed of.
