Ms. Sonam Tomar, learned counsel for the petitioner submits, that the petitioner was released from custody on 30.03.2026; and while he was on furlough, his father passed-away on 12.04.2026. 6.
By way of the present petition, the petitioner has sought extension of furlough to perform the post-demise ceremonies in respect of his late father. Ms. Tomar submits, that being the son, the petitioner's presence is required for the post-demise ceremonies, as per religious tenets and customs.
7.
Mr. Lao however submits, that while they do not oppose the extension of liberty granted to the petitioner, such liberty should not be granted by way of extension of furlough, since furlough is governed by the applicable jail rules and has to be for a limited duration. 8.
On a conspectus of the circumstances obtaining in the matter, keeping in view of the ground on which extension of furlough is sought, while at the same time giving due consideration to the submission made on behalf of the State that extension of furlough would be in violation of the jail rules, this court is inclined to instead grant to the petitioner parole for a period of 02 weeks subject to the same conditions on which furlough was granted by the jail authorities. 9.
Petition stands disposed-of in the above terms.
10. Pending applications, if any, also stand disposed-of.
11. A copy of the order be send to the Jail Superintendent for information forthwith.
