To be noted, notice in the company petition was issued on 03.02.2016 which is made returnable on 18.07.2016. The learned counsel for the petitioner says that since a settlement agreement has been arrived at with the respondent, he has instructions to withdraw the company petition.

The prayer made in the application is allowed. The company petition shall stand dismissed as withdrawn. CO.PET. 76/2016 No further orders are called for in the captioned petition, in view of the order passed in CA 1365/2016 today. CO.PET. 76/2016
